GENERAL POLICIES and GUIDELINES of ROADTECHS Internet Web Site
-It is a Roadtechs (herein after known as Roadtechs.com) General Policy that the system is to be used in a responsible, ethical, courteous, efficient and legal manner in accordance with appropriate Interet etiquette and all applicable laws of the State of Ohio and the United States of America.
-It is a Roadtechs.com General Policy that while Roadtechs.com does
not as a normal practice, review, edit or remove any material made available on
the Roadtechs.com web site, it does reserve the right to review, edit or remove
any material that Roadtechs.com, in its sole discretion, believes to be unlawful,
obscene, abusive, or an infringement of any applicable copyright laws.
-It is a Roadtechs.com General Policy that use of the Roadtechs.com site implies the understanding and acceptance of the Roadtechs.com General Policies and Guidelines
-It is a Roadtechs.com General Policy that visitors to the web site are required to understand, accept, and follow the Roadtechs.com General Policies and Guidelines.
-It is a Roadtechs.com General Policy that all users be aware that the use of Roadtechs.com is a privilege and not a right and failure to adhere to Roadtechs.com's General Policies and Guidelines and/or the Acceptable Use Policies of Roadtechs.com could result in revocation of those privileges. This determination will be made by at the sole discretion of the Roadtechs.com General Ownership.
Acceptable uses of Roadtechs.com are activities which promote technical & business communication. Users are encouraged to develop uses which meet their individual needs and which take advantage of Roadtechs.com's telecomputing functions: electronic mail, IRC, BBS's, the World Wide Web, and Links to other Internet resources.
Workers and hiring firms are to be aware that it is incumbent upon the worker to meet the minimum requirements before applying for a job posted on Roadtechs.com. All interaction with the hiring firm is the sole responsibility of the worker seeking employment, including but not limited to adhering to all requirements of the hiring firm and obtaining written confirmation of the selection of the worker for the position. All workers are to be aware that Roadtechs, LLC assumes no responsibility for the duration of any job. Any and all issues (including but not limited to compensation, injuries, lost revenue, travel expenses, lodging related or unrelated to the job) are solely and exclusively between the worker and the hiring firm. Roadtechs, LLC assumes no responsibility or liability for the professional ability, reputation of, or the quality of services provided by the hiring firm. Roadtechs, LLC makes no warranties or representations with respect to the content of any job or non-job posting, which is provided "as is".
Roadtechs, LLC accepts no responsibility or liability whatsoever arising from or in any way connected with the use of this Roadtechs.com (hereafter called “Site” within this general guideline item) or its content. In particular, Roadtechs, LLC will not be liable for the accuracy, completeness, adequacy, timeliness, or comprehensiveness of the information contained on the Site. Roadtechs, LLC also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site. Roadtechs, LLC reserves the right to interrupt or discontinue any or all of the functionality of its Site. Roadtechs, LLC accepts no responsibility or liability whatsoever for any interruption or discontinuance of any or all functionality of its Site, whether the result of actions or omissions of an entity of Roadtechs, LLC, its divisions or any third party. Any communication or material you transmit to the Site by electronic mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post becomes the property of Roadtechs, LLC or its divisions and may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, Roadtechs, LLC is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information. Information on the Site may contain technical inaccuracies or typographical errors. Roadtechs, LLC reserves the right to make changes, corrections and/or improvements to the Information on the Site, and to the products and programs described in such information, at any time without notice. Because Roadtechs, LLC has no control over and does not endorse any of the jobs posted on the Site and because Roadtechs, LLC has not reviewed any or all of the sites to which the postings on the Site are linked, you acknowledge that Roadtechs, LLC is not responsible for the content of any off-Site pages or any other sites linked to the Site. Your linking to the Site, off-Site pages or other sites is at your own risk. Although Roadtechs, LLC may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the Site, Roadtechs, LLC is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Site. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Roadtechs, LLC will fully cooperate with any law enforcement authorities or court order requesting or directing Roadtechs, LLC to disclose the identity of anyone posting any such information or materials.
Roadtechs, LLC may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current Terms and Conditions to which you are bound. From time to time, new techniques may be developed by which third parties may, without authorization, utilize content, materials, images and other intellectual property from this Site. Although the individual technique may not be described within these Terms and Conditions, Roadtechs, LLC expressly forbids such actions and declares that these are equally prohibited.
GUIDELINE II: Unacceptable uses of the network include, but are not limited to:
1. Suspected violation of Roadtechs.com's General Policies and Guidelines;
2. Suspected violation of local, state, and/or federal laws. This includes, but is not limited to, the State and Federal Computer Crime Laws. Violation of these laws may also lead to prosecution;
3. Using profane, obscene, abusive, harassing or other offensive language in publicly accessible areas of Roadtechs.com or, upon registration of a complaint, within e-mail messages;
3.1 Users are prohibited from posting or transmitting any unlawful, accusatory, threatening, libelous, propagandistic, unsubstantiated, defamatory, obscene, scandalous, inflammatory, obscene, pornographic, profane, abusive, untrue, non-authentic, or otherwise unlawful material or an material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Roadtechs, LLC will fully cooperate with any law enforcement authorities or court order requesting or directing Roadtechs.com to disclose the identity of anyone posting any such information or materials;
4. Posting personal communications of another individual without the author's prior consent;
4.1 Posting a personal employment need or availability in a Job Board.
5. Copyrighted material, text, data, graphics, or commercial software may not be placed in publicly accessible areas of Roadtechs.com without the expressed permission of the rightful owner or persons they may specifically authorize;
5.1 Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend legal notices, proprietary designations or copyright notice shall be made, nor the copyright notices be modified;
5.2 The burden of determining that any material is not protected by copyright rests with the User. The User shall be solely liable for any damages resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from any uploading, posting, or submission;
6. The planning or implementation of any illegal activity;
6.1 The planning or implementation of any unethical activity, such as solicitation for information from individuals for insider and/or proprietary information of any kind;
7. Forging of e-mail, IRC, or Job Board messages;
8. Engaging in activity that is believed to seriously degrade system performance either on the Roadtechs.com system or any other remote system. This includes, but is not limited to, e-mail chain letters, "mole" programs, generating sufficient WWW traffic as to adversely affect system performance, or any other activity that interferes with the ability of users to make use of the network;
8.1 Disorderly conduct, including, but not limited, use of profanity and / or threatening action or language to Roadtechs.com staff and/or others, or abuse of website resources, will not be tolerated. Roadtechs, LLC, in its sole discretion, will terminate accounts and/or deny access to the Roadtechs.com website as necessary when subjected to such unprofessional behavior;
9. Posting off topic messages to the Job Boards or posting the same or similar messages to a large number of Job Boards; Topic messages include the posting of the need for a job, the need for information related to a job, the posting of a need for positions. Other messages, off topic or otherwise, are subject to removal by roadtechs.com;
9.1 Any type of unsolicited e-mails (spamming of the Roadtechs.com user group/clients) is specifically prohibited. Roadtechs, LLC. takes spamming offences very seriously, and we will make sure that your Internet Access provider system admistratior is made aware of your violation of all applicable Federal and State laws. Furthermore, your Internet Service Provider will be made aware of their legal responsiblilites in the execution of all subsequent requests from Roadtechs.com in all investigations leading to the prosecution of the offender. A single spam incident may result in severe legal consequences. DO NOT SPAM
Note: A common misconception is regarding Bill S.1618 and HR 3113 claiming the spam message you're receiving is not legally considered spam. Bill S.1618 never got passed into law. HR 3113 suffered a similar fate. We at Roadtechs.com define spam very simply: If the recipient didn't ask for it, it's spam.
Roadtechs, LLC has on occasion gone after spammers on our network for compensation of lost work time spent tracking them down. Successfully, we might add.
9.1.a Any type of pyramid scheme info posted anywhere on the Roadtechs.com; any message compelling Roadtechs users to take part in a pyramid scheme WILL be reported immeadiately to your provider & the Federal Trade Commision, at: https://rn.ftc.gov/dod/wsolcq$.startup?Z_ORG_CODE=PU01; pyramid schemes are illegal; refer to the following website for details: http://www.interleaves.org/~rteeter/pyramid.html
9.1.b Any type of solicitation for funding of any non or not for profit activity will require the forwarding of the hardcopy acticles of your organizations non or not for profit registration to the state for which you applied for such status to Roadtechs, LLC at email@example.com for Roadtechs, LLC review of the legitimacy of the non or not for profit orginization; once approval to utilize the Roadtechs.com website is granted by Roadtechs, LLC, use may proceed, but NOT prior to the approval. Legitimacy does not require Roadtechs, LLC to permit posting; Roadtechs, LLC typically does not permit any such activity within the Roadtechs.com website.
9.2 Linking into another websites job boards, user group lists/discussion forums, IRC/chat, bulletin/message boards;
9.3 Proprietary Rights; Restrictions. Roadtechs.com content (i.e., data, information, graphics, etc.), design, code, underlying technology and related information are proprietary to Roadtechs.com and protected by U.S. and international copyright laws, trade secret laws, trademark laws and other laws. The posting of information or materials on this Website by Roadtechs.com does not constitute a waiver of any right in such information and materials. This Agreement does not provide User with any right or interest in Roadtechs.com’s proprietary rights related to this Website or otherwise, and all such rights shall continue to be owned by Roadtechs.com. Except to the extent express written permission is given by Roadtechs.com, User shall not copy, reproduce or otherwise duplicate this Website, in whole or in part, and shall not access or attempt to access any of Roadtechs.com’s systems, programs, data or other information or content that is not made available for public use, or use any information on this Website other than for its intended purpose. Permission is hereby given to User to view, print or download information on this site that is made available for public viewing, printing or downloading, for User's own internal use and not for republication, distribution, sale, transfer, preparation of derivative works or other use. Data mining, harvesting or similar collection of email addresses, job postings, graphics, or other information on this Website is prohibited. Roadtechs.com reserves the right to disapprove any links to this Website, in which event such links shall be immediately removed. Roadtechs.com & Roadwhore.com are trademarks of Roadtechs, LLC and may not be used without the express written permission of Roadtechs LLC. Other trademarks appearing on this site are trademarks of Roadtechs.com or others and may not be used without the express written permission of their respective owners. If User believes that any content or other aspects of this Website infringe on or otherwise violate the rights of others, User should provide notice to Roadtechs.com via email at the following address: firstname.lastname@example.org ,in which event Roadtechs.com will determine whether to investigate the matter further.
9.4 Posting of advertisments/links/references within the Roadtechs.com website to other job placement websites without the prior permission of the Roadtechs, LLC management;
9.5 Posting of commercial enterprises without the prior permission of the Roadtechs, LLC management;
9.6 The defamation of Utilities, Plants, Contract Shops, or contractors;
10. Suspected violation, or suspected attempted violation, of account, system, and/or network security, whether directed at the Roadtechs.com system or another remote system;
11. Failure to comply with Roadtechs.com's request to cease any system activity;
12. Posting of resumes within any Job Board;
13. Third party posting of employment opportunities within any Job Board; (we do permit recruiters, consulting firms, etc. to post jobs; we do not permit individuals who "hear of" or "know of" a job to post jobs.
14. Posting of Social Security Numbers, credit card information, or any other personal information within any Job Board;
GUIDELINE III: Users must be aware that though the use of on-line information access systems can be an extremely positive and enriching experience and that while Roadtechs.com can maintain limited control over what is displayed in our menu system, there exists controversial material on the Internet that may be offensive to some people due to the adult nature of its frank language and/or explicit graphics.
GUIDELINE IV: The Black Book resume database allows job seekers to post their resume information on the Roadtechs.com website and make that information available to the Roadtechs.com client recruiters. Any black Book job seeker profile marked as "Available" (indicates available for work now) or "Working" (indicates currently employed but are considering offers) are available to Roadtechs.com client recruiters for review for hiring purposes. Profiles marked "Unavailable" cannot be seen by recruiters. Recruiters shall only use Black Book resume information for hiring purposes and shall not share this information outside of their client shop.
GUIDELINE V: Users must avoid knowingly or inadvertently spreading computer viruses. Deliberate attempts to degrade or disrupt system performance will be viewed as criminal activity under applicable state and federal laws.
GUIDELINE VI: Users which have been notified, warned, suspended or blocked shall be administered in accordance with the following guidelines:
1.A first time violation of the Roadtechs.com General Policies or Guidelines will result in a warning to the user by Roadtechs.com. Unless the violation is a crime defined by the State of Ohio Computer Crime law, or any applicable federal laws, in which case the user will be reported to the applicable authorities. Roadtechs.com will send an e-mail to the user stating the policy infraction and future expectations/actions. The user will be required to write a conciliatory letter to Roadtechs.com acknowledging their responsibility/liability to conducting themselves within the Roadtechs.com General Policies and Guidelines ;
2.A second violation of the Roadtechs.com General Policies or Guidelines will result in the user being reported to their provider. Roadtechs.com will send a letter to the user & provider stating the policy infraction and history of the previous infraction(s). Upon coordination with the users provider, violations may result in blocking of the users access to Roadtechs.com permanently.
GUIDELINE VII: Roadtechs.com supports equal system access for all people regardless of race, color, religion, sex, sexual orientation, national origin, age, disability, or marital status. Any posts relating to discrimination of any persons in regards to the aforementioned status will not be tolerated.
It is illegal to advertise "any preference, limitation, or discrimination because of race, color, religion, sex,
handicap, familial status, or national origin, or intention to make any such preference, limitation, or discrimination.
Roadtechs, LLC does not permit any such posting.
GUIDELINE VIII: All Business Registration Sales are final; listings are for one year from the date of receipt of the listing form the requestor. Changes to the Business Listing Company Name or Individual Name constitute a request for a new listing, and are subject to the current Business Registration Rate Schedule. Business Registration Rates may change without notice. Business registrations are for the exclusive use of the registrant, and are non-transferable.
- Registered clients MAY NOT post jobs for other (unregistered) shops. Non-compliance with this criteria may result in denial of access to the Roadtechs.com site and forfeiture of your firm's registration fee.
GUIDELINE IX: All Banner Ad Sales are final; rates are based on the current fee schedule, shown on http://www.roadtechs.com/banad.htm. Banner Ad Rates may change without notice.
GUIDELINE X: The information, views and opinions found within this site do not necessarily reflect those of the Roadtechs, LLC General Partnership. Roadtechs, LLC does not attest to the validity, accuracy, completeness or timliness of any such information and is not responsible for its content.
GUIDELINE XI: ROADTECHS, LLC DOES NOT WARRANT THAT THE FUNCTIONS OF THIS WEB SITE WILL MEET ANY SPECIFIC REQUIREMENTS YOU MAY HAVE; NOR THAT IT WILL BE ERROR FREE OR UNINTERRUPTED; NOR SHALL ROADTECHS, LLC BE LIABLE OR RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST DATA, INFORMATION, OR PROFITS) SUSTAINED OR INCURRED IN CONNECTION WITH THE USE, OPERATION, OR INABILITY TO USE THE ROADTECHS.COM WEB SITE; USE OF ROADTECHS.COM IMPLIES INDEMNIFICATION OF THE ROADTECHS, LLC OWNERSHIP FROM ANY LIABILITY THAT MIGHT ARISE FROM ITS USE.
GUIDELINE XII: Restrictions on Use of Materials; the contents of this site are protected by copyright and trademark laws, and are the intellectual property of Roadtechs, LLC. When you download copyrighted material you do not obtain any ownership rights in that material. You may not modify, copy, publish, display, transmit, adapt or in any way exploit the content of Roadtechs, LLC. Only if you obtain prior written consent from us -- and from all other entities with an interest in the relevant intellectual property -- may you publish, display or commercially exploit any material from Roadtechs.com.
GUIDELINE XIII: Regarding responses from recruiters; In the internet era, where a single user can send hundreds of resumes a day to various recruiters, and where a recruiters job posting on Roadtechs.com may receive hundreds of resumes for a particular job, DO NOT expect that the recruiter will send you a resume receipt response or be updating you on the status of your resume. If your e-mail to the recruiter did not bounce back to you, then the recruiter has received your resume.
GUIDELINE XIV: The Roadtechs.com website registration permits the posting of individual jobs, and not the redirecting of traffic via posts to sign up/register/view jobs at another job type website, nor traffic redirects for any social engineering sites/networks, nor solicitation to clients for the purposes of promoting a company business and/or services, nor generic postings for the solicitations for resume harvesting. Non-compliance with this criteria will result in denial of access to the Roadtechs.com site and forfeiture of your firms registration fee.
GUIDELINE XV: Submission of a workers resume via an email link on a company’s Roadtechs.com job posting implies interest on the workers part for the job; The recruiter will then evaluate the workers resume and personnel references, and if found to be applicable for the clients jobs' requirements, the recruiter should then contact the worker for a verbal or electronic consent by the worker for the recruiter to present the workers resume to the client. The worker may also request that the recruiter not keep your resume on file. Workers should be particularly aware if they (the worker) have submitted resumes to multiple recruiters for the same job / project: Once a recruiter contacts a worker to begin the process to formally submit a workers resume as described above, it is incumbent upon the worker to inform any subsequent inquiry’s from other recruiters for the same job / project that he/she is already engaged in a submittal process.
GUIDELINE XVI: While the standard Roadtechs.com website registration permits the posting of unlimited jobs, the practice of frequently re-posting the same jobs to the same (or unrelated engineering discipline job board) will not be tolerated. Clients may post a specific job once per week in any or all of their registered Roadtechs.com job boards. Non-compliance with this criteria may result in denial of access to the Roadtechs.com site and forfeiture of your firm's registration fee.
GUIDELINE XVIb: Occasionally recruiters may want to notify workers that a specific license is required for work in a given state where the work location is at, or, that certain reciprocal states licenses are accepted, or, repeatedly posting the same job that is actually in location “A” in location “B”, “C”, “D”, etc. The geographical job location field in the job postings form is NOT to be used to make repeated postings for a job NOT in the actual job location.(See Guideline XVI): The job location field is just that, the location of the job.
Guideline XVII: All new and existing clients will be provided instruction and assistance whenever requested; occasionally, this assistance falls into a level of support that is over and above what is generally deemed a normal and acceptable level. Roadtechs.com reserves the right to levy charges for requests for service demands that are beyond that of normal assistance. Additionally, companies whose business practices which Roadtechs, LLC deems, in its sole discretion, to elicit a resultant level of effort beyond a normal and incidental level of involvement for Roadtechs.com may be subject to having the remainder of their account terminated.
Guideline XVIII: ATS (Applicant Tracking Systems), Specialized Job Posting Solutions (XML feed, FTP transfers), and custom job posting solutions:
The Roadtechs.com website permits registered clients to post jobs to their registered job boards via the completion of a job board posting form.
Any Third Party use of the Roadtechs.com website to post jobs (i.e., Manually, ATS [Applicant Tracking Systems], Specialized Job Posting Solutions (XML feed, FTP transfers), and custom job posting solutions) is subject to an annual maintenance fee. Additionally, any specialized posting solution requiring Roadtechs.com engineering time and efforts to integrate are subject to a one time set-up fee in addition to the annual maintenance support fee.
If a third party is going to be using the existing Roadtechs Job Posting forms to manually post jobs or to integrate with the third party ATS client, the only additional fee is:
- Roadtechs maintenance support fee for any integrator ATS Client
- If a third party requires a custom solution, such as a specialized job posting form, or a batch xml feeds or FTP transfers, a one time set-up fee applies, in addition to the annual maintenance support fee.
