Roadtechs.com ("Roadtechs") is committed to safeguarding the privacy of our website visitors. This policy sets out how we will treat the collection, use and disclosure of your personal information as a visitor and user of our website. By using our website, you agree to the collection and use of your personal information in accordance with this policy.

Information Collection And Use: While using our website, we may ask you to provide us with certain personally identifiable information that can be used by our client recruiters to contact or identify you. Personally identifiable information may include, but is not limited to your name, phone number and email address ("Personal Information"). This information may include:

Log Data: Roadtechs collects information that your browser sends whenever you visit our website ("Log Data"). This Log Data may include information such as your computer's web request, Internet Protocol ("IP") address, device identifiers, device information (such as OS type or browser type), cookie IDs, referring / exit pages and URLs, interaction information, domain names, pages viewed, crash data, and other similar technical data, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third party services such as Google Analytics that collect, monitor and analyze the Log Data.

Communications: We may use the information collected to:

Cookies: Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer's hard drive. Like many websites, we may use "cookies" to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some features of our website.

Security: The security of your Personal Information is important to us; however, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot ensure, and do not warrant or guarantee, that the information you transmit to Roadtechs will remain secure, nor do we guarantee that this information will not be accessed, disclosed, altered, destroyed or used in an unauthorized manner.

Law Enforcement: Roadtechs will cooperate with any order or request from law enforcement officials or a court of competent jurisdiction for information as to the identity of individuals submitting or posting information to the Site. Such orders or requests supersede the terms of this Privacy Policy. Additionally, notifications of claimed copyright infringement are also exempt from this Privacy Policy.

Age Restriction: The Roadtechs.com website is not intended for, nor should it ever receive data from children. We encourage parents and guardians to spend time online with their children and to participate in the interactive activities offered on other sites their children may visit. No information should be submitted to, or posted at, the Site by visitors under 18 years of age.

Changes To This Privacy Policy: This Privacy Policy is effective as of May 2024 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications indicates your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. If we make any material changes to this Privacy Policy, we will notify you via a prominent notice on our website.

General Policies

The use of the Roadtechs.com ("Roadtechs") website implies the understanding and acceptance of the policies and guidelines set forth in this User Agreement, and users of the website are required to understand, accept and follow such policies and guidelines. It is a Roadtechs policy that the system is to be used in a responsible, ethical, courteous, efficient and legal manner in accordance with all applicable laws. In addition, while Roadtechs does not as a normal practice, review, edit or remove any material made available on the Roadtechs.com website, it does reserve the right to review, edit or remove any material that it believes to be unlawful, obscene, abusive, or an infringement of any applicable copyright laws. Users of the Roadtechs website should be aware that the use of the website is a privilege and not a right and failure to adhere to the terms of this User Agreement could result in revocation of those privileges. This determination will be made by at the sole discretion of the Roadtechs management team. As such, Roadtechs reserves the right to refuse service to any order, person or entity, without the obligation to assign reason for doing so.

Guidelines

Guideline 1: Acceptable Use

Acceptable uses of the Roadtechs website are activities which promote technical and business communication. Users are encouraged to develop uses of the website which meet their individual needs.

Job seekers and hiring firms are to be aware that it is incumbent upon the job seeker to meet the minimum requirements before applying for a job posted on the Roadtechs.com website. All interaction with the hiring firm is the sole responsibility of the worker seeking employment, including but not limited to adhering to all requirements of the hiring firm and obtaining written confirmation of the selection of the worker for the position. All workers are to be aware that Roadtechs assumes no responsibility for the duration of any job. Any and all issues (including but not limited to compensation, injuries, lost revenue, travel expenses, lodging related or unrelated to the job) are solely and exclusively between the worker and the hiring firm. Roadtechs assumes no responsibility or liability for the professional ability, reputation of, or the quality of services provided by the hiring firm. In addition, Roadtechs makes no warranties or representations with respect to the content of any job or non-job posting, which is provided "as is" on the website.

It is the responsibility of the hiring firm to perform pre-employment screening (or "vetting") of prospective candidates. Roadtechs assumes no responsibility for the accuracy of a candidate’s stated work experience or any other aspect of the candidate's status, professional or otherwise. Roadtechs assumes no responsibility for any candidate’s professional or personal performance.

Guideline 2: Limited Liability

Roadtechs accepts no responsibility or liability whatsoever arising from or in any way connected with the use of the Roadtechs.com website its content. In particular, Roadtechs will not be liable for the accuracy, completeness, adequacy, timeliness, or comprehensiveness of the information contained on the website. Roadtechs also assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing on the website or your downloading of any materials, data, text, images, video, or audio from the website.

Roadtechs reserves the right to interrupt or discontinue any or all of the functionality of its website, and therefore, accepts no responsibility or liability whatsoever for any interruption or discontinuance of any or all functionality of its website, whether the result of actions or omissions of an entity of Roadtechs or any of its divisions or any third party.

Any communication or material you transmit to the website by electronic mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as non- confidential and non-proprietary. Anything you transmit or post publicly on the website becomes the property of Roadtechs and may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting.

Information on the website may contain technical inaccuracies or typographical errors. Roadtechs reserves the right to make changes, corrections and/or improvements to the information on the website, and to the products and programs described in such information, at any time without notice. Roadtechs has no control over and does not endorse any of the jobs posted on the website and has not reviewed any or all of the sites to which the postings on the website are linked. Therefore, you acknowledge that Roadtechs is not responsible for the content of any off-site pages, or any other sites linked to the website. Your engagement and use of the Roadtechs.com website, off-site web pages, or other websites is at your own risk.

Although Roadtechs may from time to time monitor or review discussions, chats, transmissions, bulletin boards, and other postings on the website, Roadtechs is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the website. In addition, as a user of the website, you are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Roadtechs will fully cooperate with any law enforcement authorities or court order requesting or directing Roadtechs to disclose the identity of anyone posting any such information or materials.

Guideline 3: Unacceptable Use

Unacceptable uses of the network include, but are not limited to, the following list:

  1. Suspected violation of Roadtechs User Agreement as set forth herein.

  2. Suspected violation of local, state, and/or federal laws.

  3. Using profane, obscene, abusive, harassing, or other offensive language in publicly accessible areas of Roadtechs.com or, upon registration of a complaint, within e-mail messages. Users are prohibited from posting or transmitting any unlawful, accusatory, threatening, libelous, propagandistic, unsubstantiated, defamatory, obscene, scandalous, inflammatory, obscene, pornographic, profane, abusive, untrue, non-authentic, or otherwise unlawful material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Roadtechs will fully cooperate with any law enforcement authorities or court order requesting or directing Roadtechs to disclose the identity of anyone posting any such information or materials.

  4. Posting personal communications of another individual without the author’s prior consent.

  5. Using copyrighted material, text, data, graphics, or commercial software may not be placed in publicly accessible areas of the Roadtechs.com website without the expressed permission of the rightful owner or persons they may specifically authorize. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of the copyright owner. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend legal notices, proprietary designations or copyright notice shall be made, nor the copyright notices be modified. The burden of determining that any material is not protected by copyright rests with the user, and the user shall be solely liable for any damages resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from any uploading, posting, or submission.

  6. The planning or implementation of any illegal activity; and, the planning or implementation of any unethical activity, such as solicitation for information from individuals for insider and/or proprietary information of any kind.

  7. Falsifying an e-mail or job board message.

  8. Engaging in activity that is believed to seriously degrade system performance either on the Roadtechs.com system or any other remote system, including knowingly spreading computer viruses. Deliberate attempts to degrade or disrupt system performance will be viewed as criminal activity under applicable state and federal laws. Also, engaging in disorderly conduct while using the website is unacceptable, including, but not limited to, the use of profanity and/or threatening action or language to Roadtechs management, staff or others at Roadtechs, or abuse of website resources. Roadtechs in its sole discretion, will terminate accounts and/or deny access to the Roadtechs.com website as necessary when subjected to such unprofessional behavior.

  9. Posting off topic messages to the job boards or posting the same or similar messages to many job boards. Topic messages include the posting of the need for a job, the need for information related to a job, and the posting of a need for positions. Other messages, off topic or otherwise, are

    subject to removal by Roadtechs, as well as posting of advertisements/links/references within the Roadtechs.com website to other job posting websites without the prior permission of the management at Roadtechs.

  10. The Roadtechs.com content, design, code, underlying technology and related information are proprietary to Roadtechs.com and protected by U.S. and international copyright laws, trade secret laws, trademark laws and other laws. The posting of information or materials on this website by Roadtechs does not constitute a waiver of any right in such information and materials. This User Agreement does not provide the user with any right or interest in Roadtechs’ proprietary rights related to this Website or otherwise, and all such rights shall continue to be owned by Roadtechs. Except to the extent express written permission is given by Roadtechs, the user shall not copy, reproduce or otherwise duplicate this website, in whole or in part, and shall not access or attempt to access any of Roadtechs’ systems, programs, data or other information or content that is not made available for public use, or use any information on this website other than for its intended purpose. Permission is given to the user to view, print or download information on this website that is made available for public viewing, printing or downloading, for user’s own internal use and not for republication, distribution, sale, transfer, preparation of derivative works or other use. If the user believes that any content or other aspects of this Website infringe on or otherwise violate the rights of others, then the user should provide notice to Roadtechs via email at the following address: info@roadtechs.com, in which event Roadtechs will determine whether to investigate the matter further.

Guideline 4: Black Book Database

The Black Book resume database allows job seekers to post their resume information on the Roadtechs.com website and make that information available to the Roadtechs.com client recruiters. Any Black Book job seeker profile marked as "Available" (indicates available for work now) or "Working" (indicates currently employed but are considering offers) are available to Roadtechs.com client recruiters for review for hiring purposes. Profiles marked "Unavailable" cannot be seen by recruiters. Recruiters will refrain from contacting job seekers who have indicated that they are "Unavailable." Recruiters shall only use Black Book resume information for their in-house hiring purposes and shall not share resume information outside of their client shop. Black Book login credentials are assigned to a specific recruiter and must never be shared with anyone. If Roadtechs determines that you have shared your Black Book login credentials, your account will be deleted and will not be provided in the future.

Guideline 5: Violation of the User Agreement

Users which have been notified, warned, suspended or blocked from using the Roadtechs.com website shall be administered in accordance with the following guidelines:

  1. Falsifying an e-mail or job board message.

  2. A first time violation of the User Agreement will result in a warning to the user, unless the violation is a crime, in which case the user will be reported to the applicable authorities. Roadtechs will send an email to the user stating the policy infraction and future expectations/actions. The user will be required to write a conciliatory letter to Roadtechs acknowledging their responsibility/liability to conducting themselves within the Roadtechs.com website User Agreement.

  3. A second violation of the User Agreement will result in the user being reported to their provider. Roadtechs will send a letter to both the user and provider stating the policy infraction and history of the previous infraction(s). Upon coordination with the user’s provider, violations may result in blocking of the users access to Roadtechs.com permanently.

Guideline 5: Equal Access and Non-Discrimination

Roadtechs supports equal system access for all people regardless of race, color, religion, sex, sexual orientation, national origin, age, disability, or marital status. Any posts relating to discrimination of any persons in regard to the aforementioned status will not be tolerated. It is illegal to advertise any preference, limitation, or discrimination because of race, color, religion, sex, handicap, familial status, or national origin, or intention to make any such preference, limitation, or discrimination. Roadtechs does not permit any such posting. As such, Roadtechs shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from any such post made to the Roadtechs.com website. All persons using the Roadtechs.com website, to view a post or place a post, shall adhere to this Guideline as part of this User Agreement; furthermore, any use of the Roadtechs.com website implies compliance and acceptance of the aforementioned agreement.

Guideline 6: Sales

All business registration sales are final and subject to the terms and conditions as set forth in each Roadtechs Subscription Agreement. Changes to the client company name or individual name constitute a request for a new listing and are subject to the current subscription rate schedule. Subscription rates may change without notice. Subscriptions are for the exclusive use of the subscriber and are non-transferable; one domain name is permitted per subscriber. Sister companies, subsidiary companies, and affiliate companies having a different domain name from the client subscriber are not included in the subscription and would require an account of their own to post jobs. Registered clients may not post jobs for other unregistered shops. Non-compliance with these criteria may result in denial of access to the Roadtechs.com site and forfeiture of your firm’s subscription fee. In addition, all banner ad sales are final. Banner ad rates may change without notice.

Guideline 7: Submission of Resume

Submission of a job seeker’s resume via an email link on a company’s Roadtechs.com job posting implies interest on the workers part for the job. The recruiter will then evaluate the job seeker’s resume and personnel references, and if found to be applicable for the client’s requirements, the recruiter should then contact the job seeker for a verbal or electronic consent for the recruiter to present the job seeker’s resume to the client. The job seeker may also request that the recruiter not keep the resume on file. Job seekers should be particularly aware if they have submitted resumes to multiple recruiters for the same job or project. Once a recruiter contacts a job seeker to begin the process to formally submit a resume as described above, it is incumbent upon the job seeker to inform any subsequent inquiries from other recruiters for the same job/project that he or she is already engaged in a submittal process.

Guideline 8: Posting Guidelines 

While the standard Roadtechs.com website registration permits the posting of unlimited jobs, the practice of frequently re-posting the same jobs to the same job board will not be tolerated. Clients may post a specific job once per week in any or all of their registered Roadtechs.com job boards. Non-compliance with these criteria may result in denial of access to the Roadtechs.com site and forfeiture of your firm’s registration fee.

In addition, occasionally recruiters may want to notify workers that a specific license is required for work in a given state where the work location is at, or that certain reciprocal states licenses are accepted; or repeatedly posting the same job that is actually in a separate location. The geographical job location field in the job posting form must be the actual job location in each posting.

All new and existing clients will be provided instruction and assistance for job posting whenever requested; however, Roadtechs reserves the right to charge clients an additional fee for requests for service demands that are beyond that of normal assistance.

Guideline 9: Warranty

ROADTECHS, LLC DOES NOT WARRANT THAT THE FUNCTIONS OF THIS WEBSITE WILL MEET ANY SPECIFIC REQUIREMENTS YOU MAY HAVE; NOR THAT IT WILL BE ERROR FREE OR UNINTERRUPTED; NOR SHALL ROADTECHS, LLC BE LIABLE OR RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST DATA, INFORMATION, OR PROFITS) SUSTAINED OR INCURRED IN CONNECTION WITH THE USE, OPERATION, OR INABILITY TO USE THE ROADTECHS.COM WEB SITE; USE OF ROADTECHS.COM IMPLIES INDEMNIFICATION OF THE ROADTECHS OWNERSHIP FROM ANY LIABILITY THAT MIGHT ARISE FROM ITS USE.

Revisions to User Agreement

Roadtechs may at any time revise this User Agreement by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the current policies and guidelines to which you are bound. From time to time, new techniques may be developed by which third parties may, without authorization, utilize content, materials, images, and other intellectual property from this website. Roadtechs expressly forbids such actions and declares that these are equally prohibited if developed without proper authorization.

Roadtechs reserves the right to prohibit conduct which it deems, in its sole discretion, to be harmful to subscribers or damaging to the communities that compromise Roadtechs.com, and users agree to abide by any additional rules of conduct that Roadtechs may adopt from time to time. Roadtechs cannot, and does not intend to, screen or monitor all communications and other material in advance

for adherence to Roadtechs standards. However, notwithstanding anything in this User Agreement to the contrary, Roadtechs reserves the right (but is not obligated) to review, delete or edit any material placed on the Roadtechs.com website.
